The detention of Dele Farotimi in an Ekiti State correctional facility has raised questions about the fairness of his trial and the appropriateness of using law enforcement in civil disputes. Speaking on Channels Television’s Lunch Time Politics from 17:58, human rights activist Inibehe Effiong criticized the decision of Chief Afe Babalola, a former Attorney General of the Federation and elder statesman, to involve the police instead of pursuing a civil suit.
“For a man of that stature, one of the most respected Nigerians alive, why does he have to use the instrumentality of state power? Why not simply go to court to file a civil suit?” Effiong questioned, adding that Farotimi had been remanded in prison only moments earlier.
Effiong expressed doubts about the ability of Farotimi to receive a fair hearing in Ekiti State, where the case is being tried. He noted that the involvement of the Ekiti State Police Command in arresting Farotimi under questionable circumstances further complicates the perception of impartiality.
This incident, stemming from a defamation complaint related to comments in Farotimi’s book, has ignited debates on the misuse of state instruments for personal grievances. Critics argue that involving law enforcement in such matters undermines the principle of civil redress and threatens freedoms of expression and due process.
Farotimi’s case continues to attract widespread attention, with observers closely monitoring developments as his next court date approaches on December 10, 2024. Concerns over procedural violations and fairness are expected to dominate discussions surrounding the trial.
“For a man of that is the former Attorney General of the Federation, one of the most respected Nigerians alive. I thought as an Elder Stateman of that age, you could have gone to Court to file a civil suit. Why does he have to use the Police? Why does he have to use the Instrumentality of State. As I speak to you, Dele Farotimi has been remanded in Prison. In the correctional centre barley few minutes ago. Can Dele Farotimi get fair hearing in Ekiti State, that is the question that I’m hoping would be answer.” He said
