Oba Maduabuchi, a Senior Advocate of Nigeria (SAN), has stated that the admission by PDP members who defected to the APC, acknowledging their departure from their original party, is binding and cannot be overturned by court rulings.
In an interview with Arise News From 2:35, Maduabuchi emphasized that the defectors had sworn affidavits in various courts, admitting their departure from the PDP and joining the APC. He added that their public declarations and celebrations, captured on record, further solidify their admission.
Maduabuchi, a legal expert, stressed that while courts may rule in favor of the defectors, the rule of law dictates that a court without jurisdiction cannot make a binding decision, regardless of the outcome. He reiterated his commitment to upholding the rule of law and the Constitution.
In his words;
“The most these PDP members can do is to pretend that they did not decamp and that’s what they’ve been trying to do m, but they forgot that they have sworned affidavit in various courts admitting that they left their party and joined APC. When they were dancing and singing on your mandate we stand, they were recorded. So I do not see how that will be any problem for anybody, but we as Lawyers we believe in the rule of law. If a Court does not have jurisdiction, no matter how well the thing is decided. It does not have jurisdiction”
