According to a report that was published on the official X account of PUNCH on Saturday, October 18, the President of the Nigeria Bar Association, Afam Osigwe, SAN has reacted to the statement that was made by Nigerian lawyer, Kenneth Okonkwo after Bayelsa state governor, Douye Diri resigned from the Peoples Democratic Party, PDP.
According to report, Kenneth Okonkwo said after the Bayelsa state governor announced his resignation from the PDP, he didn’t join a new party. He said for that reason, his seat must be declared vacant and the Independent National Electoral Commission, INEC must conduct a fresh governorship poll in the state within 90 days.
Reacting, the NBA President said it doesn’t work that way. He said governors can adopt new parties as many times as they want. The NBA President said there is no provision in the constitution that says a governor must be removed because he changed a party. He said a similar issue has already been settled by the Supreme Court.
According to PUNCH, Afam Osigwe said that;
“There is no provision in the constitution allowing the removal of a governor because he changed parties. A governor can defect 50 times, and there will still be no legal basis to declare his seat vacant”. See, More, Here>>>
