Former Judge of the Court of Appeal, Justice Mojeed Adekunle Owoade, has stated that while the Supreme Court has performed its role, there remains a legal gap regarding the status of the 27 defected lawmakers in Rivers State.

He explained that the uncertainty arose because the Supreme Court made comments on defection but did not explicitly rule on whether any appeal or cross-appeal on the matter was considered. He noted that the court’s stance seemed influenced by previous rulings from the High Court of Rivers State and the Court of Appeal, which addressed defection-related cases.

He said in a live coverage by Symfoni, “The Supreme Court has functioned officially, they have done their bit. What we call a gap—was because they made comments on defection, and we were not too sure whether they actually considered any appeal or cross-appeal on the defection.”

“But their attitude was that because of previous decisions which they have seen—that is, the High Court of Rivers State and the Court of Appeal relating to defection—they know that as of the time of writing, the Supreme Court did not expressly declare that the 27 members are no longer part of the assembly.
