Former Chairman of Ikwerre Local Government Area in Rivers State, Samuel Nwanosike, has weighed in on the court case involving Governor Siminalayi Fubara and the Rivers State House of Assembly, led by Speaker Martin Amaewhule.
In an interview with TVC, Nwanosike remarked that Governor Fubara’s camp miscalculated. He explained that when a court ruling is not appealed, it becomes final and binding on the losing party. He further noted that the governor’s legal team failed to overturn the Court of Appeal’s decision, which upheld Justice Omotoso’s ruling that recognized Amaewhule as the legitimate Speaker of the Rivers State House of Assembly.
According to Nwanosike, the legal outcome was clear, and Femi Falana, Governor Fubara’s lawyer, was well aware of the case’s weaknesses. He added that the decision to withdraw the case at the Supreme Court stemmed from an understanding that it would not succeed.
In his exact words: “Supreme Court has finished that matter. Martin Amaewhule being the Speaker of Rivers State House of Assembly is the law of Nigeria as we speak. It is unfortunate but they fell into the trap. So Femi Falana can come to tell anybody anything he wants to say, but he knows the truth. He knows it was a bad case ab initio, so he knows it is something that cannot stand before the Supreme Court justices, so that is why they withdrew the case.”
As of now, the Court of Appeal’s judgment affirming Amaewhule as Speaker remains legally binding.
